A non-US freelancer does not need an ITIN to be paid on Upwork or Fiverr. US payers document the people they pay with IRS forms: a W-9 from US persons and, from a non-US individual, a W-8BEN, which certifies foreign status so that US reporting and withholding rules are applied correctly. The IRS instructions say an SSN or ITIN, or the tax identification number your own country issued, is needed to claim certain treaty benefits; otherwise the form stands without a US number. The ITIN matters when you claim a treaty rate and your country issues no tax number, when a US client pays you directly and asks for a taxpayer number, when you file a US return, and when you want the US bank account and cards a freelance business grows into.
Do Upwork or Fiverr require an ITIN?
No. US payers document the people they pay with IRS forms: a W-9 from US persons and, from a non-US individual, a W-8BEN, which certifies that you are not a US person, states your country of residence and lets you claim a treaty rate where one exists. Its instructions say that to claim certain treaty benefits you complete line 5 with an SSN or ITIN or line 6 with the tax identification number your own country issued; outside those claims the form stands without a US number. The platforms' own tax help pages refused every automated read we attempted on September 14, 2026, so read the current instructions inside your account; the IRS form behind them is the same for every platform.
When does withholding hit a non-US freelancer?
US withholding attaches to US-source income paid to a non-US person: the IRS says most types of US-source income received by a foreign person are subject to US tax of 30 percent, generally withheld from the payment, unless a Code section or a treaty provides a lower rate. For services, the IRS says the place where the work is performed generally determines the source, regardless of where the contract was made, where payment is made or where the payer lives (IRS, read September 14, 2026). A freelancer working from outside the United States for a US client is therefore generally earning income that is not US-source, which is why most non-US freelancers see no US withholding once the W-8BEN is on file. Whether your particular income is US-source, and whether a treaty changes anything, is a question for your tax adviser; we do not answer it.
When does the ITIN help a freelancer?
| Situation | ITIN needed? | Why |
|---|---|---|
| Getting paid on Upwork or Fiverr with a W-8BEN on file | No | The form certifies foreign status; a US number is needed only for certain treaty claims. |
| Claiming a treaty rate when your country issues no tax identification number | Yes, as the US number | The W-8BEN instructions ask for an SSN or ITIN on line 5 or a foreign number on line 6. |
| A US client pays you directly and asks for a taxpayer number | Often | The client reports the payment under a number; many will not onboard without one. |
| You file a US return your adviser says is due | Yes | The W-7 is filed with it. |
| A US bank account and cards for the freelance business | Yes, in practice | Banks and issuers identify you by taxpayer number and passport. |
| Treaty claim on compensation for work performed in the US, with Form 8233 | Yes, under Exception 2(a) | With an original letter or contract from the payer (Publication 1915). |
From platform freelancer to US business
The platform takes its fee and pays you in your own currency or into a dollar account. Fine at the start. The freelancers who become agencies notice three things in year two: US clients want to pay a US company through a US bank, the software and advertising they buy is priced in dollars and charged foreign-transaction fees on a non-US card, and nobody will extend them credit because no US file exists. Alvaro, a media buyer from Spain running around $100,000 a month in client ad spend, arrived in Miami with the number and prepared documents. His base today is Bank of America and Truist, opened in person, on an ITIN. It was actually pretty easy once I got to the bank and I did exactly what they said, he told us.
Company or personal?
Many freelancers form a US LLC to invoice US clients and are surprised that the company's EIN does not identify them. The EIN goes on a W-8BEN-E for the company's payments; the owner is still a person the bank, the card issuer and the IRS identify separately, and for a non-US owner that is the ITIN. The LLC owner's guide covers the filings a foreign-owned company carries, including the one with a $25,000 penalty.
How a freelancer gets the number
Form W-7 with a valid passport, filed with the return that needs the number or under one of the five exceptions in the instructions; a freelancer claiming treaty benefits on compensation for work performed in the United States may fit Exception 2(a), with a letter or contract from the payer and Form 8233, and the pairing is checked before filing. The IRS allows 7 weeks, 9 to 11 in the January 15 to April 30 peak or from abroad, and charges nothing. Through a Certifying Acceptance Agent the passport is verified in a live video session and certified, so it never travels. Our fee is $399, refundable until we file.
