A foreign real estate investor needs an ITIN when a US tax event in their name requires one: when a US property is sold and the buyer must withhold under FIRPTA, when the seller applies for a withholding certificate to reduce that withholding, when rental income is reported or a return is filed, and when a lender reports mortgage interest. The IRS will not issue an ITIN in advance of a sale to someone with no other valid reason; the number is applied for when the reason exists, which is why timing the W-7 to the transaction matters.
When does a foreign property investor need an ITIN?
At the moments US tax law attaches to the property and to you. The IRS FIRPTA page explains the sale: the disposition of a US real property interest by a foreign person is subject to income tax withholding, and the buyer generally withholds 15 percent of the amount realized and remits it to the IRS with Forms 8288 and 8288-A. Those forms carry the seller's taxpayer number, and a seller who wants to reduce the withholding or claim a refund of the excess needs a number to do it under.
Rental income is the second moment: rent paid to a foreign owner is US-sourced income that is reported and, absent an election to treat it as connected with a US business, withheld on. Filing the return that reports the rent needs the number. The mortgage is the third: a lender that reports the interest you pay, usually on Form 1098, asks for it, which is Exception 3 in the W-7 instructions.
The FIRPTA sale, step by step
| Moment | What happens | Where the ITIN enters |
|---|---|---|
| Contract signed | The buyer, as withholding agent, must withhold at closing; 15 percent of the amount realized in the general case | You may now apply: the pending disposition is a valid reason (Exception 4) |
| Withholding certificate | Form 8288-B asks the IRS to reduce or eliminate the withholding; the IRS generally acts within 90 days of a complete application | The application must include the taxpayer numbers of all parties |
| Closing | The buyer remits the withholding with Forms 8288 and 8288-A | Your number goes on the forms; without it the credit is harder to match to you |
| Return for the year of sale | You report the gain and claim the withholding against the tax due | The return carries the ITIN; a refund of excess withholding follows the return |
The timing rule that catches people
You cannot get the number early just because a sale is coming. The IRS's own FIRPTA page answers the question directly: may a foreign person request and receive an ITIN prior to entering into a contract to dispose of a US real property interest if they have no other valid reason to obtain an ITIN? No. A foreign person who does not have a valid reason cannot request an ITIN before entering a contract to dispose of the property.
The practical consequence: the W-7 under Exception 4 is filed once the contract exists, with the transaction documents the instructions name, and the IRS's 7 to 11 weeks run alongside the closing timeline. Investors who already have a valid reason, rental income being reported, a mortgage being reported, a return to file, get the number before the sale and arrive at closing with it. That is the calmer path, and the one we plan for.
Rental income and the return
Rent paid to a non-resident owner is reported to the IRS by the property manager or tenant under the owner's number, and the owner decides, with an adviser, whether to have it taxed on the gross with withholding or to file a return that treats it as business income and deducts expenses. Both paths need the ITIN: the first because the payer reports and withholds under it, the second because the return is filed under it. Which election is right for you is tax advice, and we do not give it. Getting the number that either path requires is what we do.
The mortgage
Foreign buyers who finance a US purchase meet the number at the lender. A US lender reports the mortgage interest it receives on Form 1098 and asks the borrower for a taxpayer number to report under; Publication 1915 describes this as Exception 3, third-party reporting of mortgage interest, and notes that first-time filers who secure a home loan may seek an ITIN to provide to their lender. The evidence for the W-7 is the mortgage documentation the instructions name.
What the ITIN does not do for an investor
- It does not reduce the FIRPTA rate by itself. The withholding certificate does that, and the IRS decides it.
- It does not decide your tax residence, your treaty position or which election to make on rental income. Those are your adviser's questions.
- It does not open a US bank account or a mortgage on its own. Lenders and banks decide on your file; the number is what they file it under.
How the investor gets the number
Form W-7 with a valid passport, filed with the return that needs it or under Exception 3 or 4 with the documents the instructions specify. Through a Certifying Acceptance Agent the passport is verified in a live video session and certified, so nothing is mailed across a border during a transaction. The IRS allows 7 weeks, 9 to 11 in the January 15 to April 30 peak or from abroad, and charges nothing; our fee is $399, refundable until we file.
